General conditions

The site www.gfl.eu is owned by GFL S.A. (The "Seller"), a Swiss company (société anonyme) with registered office in via Sorengo 1, Lugano TI, Switzerland with a share capital of CHF 1,000,000 (one million) and entered in the register of Commerce of Lugano number CHE-301633770. The following Terms and Conditions ("Terms and Conditions") apply to the offer and sale of products made through the site www.gfl.eu. The www.gfl.eu site will be hereinafter defined as the "Site."
Purpose of the site is the sale of cosmetics or other products (the "Products") by GFL SA to the Internet users who visit the site ("Internet Users"). To be eligible to make purchases on the Site, Internet users must: a) be at least 18 years or be authorized by their legal representative; b) be end users, that is, either individuals or legal persons acting outside their business purpose; c) be in possession of a valid credit card.
All orders of products offered on the Website require the consultation and express acceptance of the Terms of Sale by flagging the specific box before completion of the order. Purpose of the Terms of Sale is to define the rights and obligations of the Seller and the obligations of the Internet Users exclusively in connection with the sale of products through the site and identify all the steps required to complete an order between the Parties.
These conditions can be modified and the publication date on the site corresponds to the date of entry into force. Terms of Sale in force at any given time can be found by clicking the dedicated link on the Site. In the e-mail of any order confirmation, Internet Users will also receive the link to download and store a copy of these Terms of Sale.


Products

The Products available for purchase are listed on the site, in the limits of the available stock.
The Seller undertakes to describe and present the items sold on the site as well as possible. Nevertheless, there might be some errors, inaccuracies or small differences between the site and the actual product. In addition, photos of products featured on www.gfl.eu do not constitute part of a contract, being only representative.Products are intended solely for personal use and Internet Users are not allowed to sell or re-sell them. The Seller reserves the right to cancel or reduce, with or without notice, the amount of products to be provided to Internet Users when it considers, in its sole discretion, that a breach of these Terms of Sale may take place.
The products are offered in the available stock limits. If a product is not available, this will be mentioned on the site and it will not be possible to proceed with the order entry process for that product.
The product remains the property of the Seller until full receipt of the price. If, for whatever reason, payment has not been received, in whole or in part, by the Seller, the Buyer agrees to return at his expense the products received to the Seller if the latter so requests. In any case, as of the date of actual delivery, Buyer assumes all risks (in particular loss, theft or damage) concerning the Products delivered.


Prices

All prices listed on the site include VAT at current rates and are expressed in Euro.
Prices do not include shipping costs, which will be counted in addition to the price specified in the Internet Users before the order is valid and also subsequently. As far as delivery charges, please refer to the section "Delivery".
The Seller reserves the right to change prices at any time; in any case the Products will be sold at the price in effect at the time of the order.
The Seller undertakes to ensure that the prices indicated on the Site is accurate, but can not guarantee the absence of errors. In the case of obvious error, it leaves the Purchaser right to buy the product at the correct price or cancel the order.


Orders and payment methods

To place an order you must select one or more Products on the Site and add them in the "Shopping cart" through the "Add to basket" button. Once the selection of Products of interest, you must click on "Shopping cart” > "View Cart" to display all selected products. It is the Internet User's responsibility to verify that the selected products are the ones that actually he/she intends to purchase, in terms of both code and quantity. At this stage you can either remove (by clicking on "Delete") a product, either change the quantity (by selecting the desired quantity on the "Quantity" button). In any case, you can not make an order for an amount higher than CHF 1,500.

Then clicking on the button "Proceed to checkout" you will be directed to the login page if you have not yet logged in or registered, or if you have already completed the registration and login, directly in the "Billing / Shipping" section where you can enter the billing and delivery information and select the method of delivery. As far as delivery mode, see the section "Delivery".

Before the validation of the order with obligation to pay through the "Buy" button, the Internet User:
a)
is informed regarding:
- the total price of goods inclusive of taxes, with the details of shipping and any other costs;- the method of payment;
b)
declares, by flagging the specific box, the knowledge and acceptance of these Terms and Conditions, and in particular:
- The conditions, terms and procedures for exercising the right of withdrawal;
- The obligation to bear the cost of returning the goods in case of withdrawal;
- The existence of the legal guarantee of conformity for goods purchased.


The payment of the order can be made exclusively via credit cards (Visa, Mastercard and American Express) or through Paypal. After selecting the chosen payment method, the Internet User will be directed to a page made available by the payment system provider (Ingenico) or by Paypal where will be requested data such as credit card number, period validity, cardholder name and card security code, or in case of Paypal, username and password of their account.
If the payment is carried out successfully, you will see a message confirming the payment. Otherwise, if the payment is not authorized by the credit card organization or by Paypal, a message will appear indicating the lack of authorization and hence the failure to finalize the order.


In case of successful payment, the Seller will send the Internet User a confirmation email with the details of the order, with the link to download and store a copy of the these Terms of Sale. Upon receipt of such e-mail the order you can be considered finalized.
The Seller reserves the right to refuse all orders and deliveries: a) if the payment authorization is refused, or in any other case of non-payment, in whole or in part; b) if the order exceeds CHF 1,500; c) in the event of a dispute with the Internet User.


Delivery

Orders are processed only on weekdays (from Monday to Friday excluding holidays and periods of business closure). Orders placed on Saturdays and Sundays, public holidays and days of business closure will be processed as soon as possible but no later than 5 working days from receipt of order.
Orders are delivered to the shipping address indicated by the Internet User at the time the order is the Internet. Deliveries to PO boxes or poste restante are not possible.
The ownership of products is transferred to the Internet User who made the purchase (the “Customer”) only when the Seller has received full payment of the price, inclusive of shipping costs and any additional charges.
The method of delivery can be selected prior to entering the order and the related costs are detailed in the following table:

Estimated delivery times are: 1-2 business days from shipment date for Italy and 1-5 business days from shipment date for the rest of Europe, Norway, Switzerland and United Kingdom (temporarily unavailable).


When the shipment is made, the courier will send the Customer a confirmation e-mail with the details and contacts, as well as the expected date of delivery.

The delivery date is to be considered as only indicative. The Seller assumes no responsibility for any disruptions or delays in delivery due to causes of force majeure or unforeseeable circumstances, even if due to malfunctions and disruptions of the Internet, if he is unable to execute the order within the times provided for in the contract.
In case of delay in the receipt of the product, the Internet User that made the purchase must promptly inform the Seller by email tocustomercare@gfl.eu
Upon receipt of the Products, the Customer is required to verify that the products comply with the order made in quality and quantity. Any anomalies on the transport (missing products, damaged parcels or packages, etc.) must necessarily be reported at the time of delivery to the shipper and, in any case, to the Seller by the e-mail to customercare@gfl.eu providing proper proof within 14 days of receipt, term after which the Seller is relieved from any liability and the Customer loses the right to a replacement or refund. In this regard it is important to remember that the Customer has the obligation to verify compliance with the goods received, in quantity and quality, before he/she accept the parcel from the courier. Once the Customer has picked up the parcel without affixing any reservations, delivery will be deemed as accepted. Documents with a generic "control reservation" will not be accepted, since they do not protect in any way the Seller against the courier.
In case the courier is not able to dispatch the parcel due to wrong address, wrong telephone number, failure of second attempt, no collection during deposit period, etc. and returns it to the Seller, the Seller will automatically refund the price to the Buyer net of shipping costs, custom charges as well as all the extra costs charged by the courier for the deposit and return, also in case of purchases completed in free shipping.


Right of withdrawal

The Customer has the right to withdraw from the purchase of one or more products within 14 days from delivery date notifying the seller by e-mail at customercare@gfl.eu and providing the following information:
- Order number
- Date of receipt of the order
- Item code and description of products you intend to return
- Reason for return
- Name and address of Customer
The Seller will communicate as soon as possible by e-mail a code ( "NAR Code") to be transmitted together with the / the product / s to be returned and the address to which products have to be sent back. The product (or products) must be returned to the Seller within 15 days after receipt of the NAR code and must be unused and undamaged, with their seals and original packaging and carefully stored. The shipping costs are borne by the Customer and parcels with shipping costs charged to the recipient will not be accepted.
If all the above conditions are met, the Seller will refund the price of the products returned within 30 days from the receipt of goods excluding shipping charges and customs fees. Refund will be made solely through the payment instrument used for the order process.


Applicable law

These Terms and Conditions are governed by and shall be interpreted in accordance with Swiss law.
Any dispute concerning the interpretation, validity and / or application of these Terms of Sale shall be postponed to the jurisdiction of the Court of the Canton of Ticino.
